I get it though, if freedom of expression in any form is a protected right then it shouldn't be illegal.

The flag is a symbol.

Sure it can be disrespectful to burn the flag. It can offend the military officers or the conservatives who see it at symbol of everything that is America.

But this country was founded on the right to protest. I have no doubt that burning the British flag during the revolution was done. Would it be punishable to write an article completely trashing the constitution or the president? No and it shouldn't be, people do it all the time.

Once the institution begins enforcing rules that eliminate protest or any form of non-violent expression against the government, said institution becomes an oppressive state. Look at North Korea...

It is a piece of fabric and anyone who thinks it should be punishable by law doesn't not know much about the principles of the nation.

I can't believe there is a 4 page debate on this issue.

isn't this topic opposing burning the American flag.. in America?
You don't think that a manufacturer tries to use a replica flag as a tag for a reason?

They are using the marketing of a symbol because of what it means.

What about a shirt with the US flag on it? Does it count?

What if I make a shirt out of the US flag? Does that count?

(A point I am trying to make in all this is that due to the gray area, how do you word a law that is very restrictive and precise, outlawing some behavior under certain conditions but nother other behavior or other conditions?

And then the practicality of trying to enforce it, the legal challenges and defense of such events...

The amount of time, and money spent on this law would be immense. And then for a very plausible and likely constitutional challenge to invalidate the law...

I am sure Congress has a lot more important things to do...for example, protecting the rights the Constitution actually gives people.)

It would be hard to make flag burning illegal while keeping free speech laws intact...
Isn't it ironic that these same people want to basically kill talk radio?

A flag is a symbol. I don't believe doing anything to a symbol as long as its your property is wrong. If you burned a bible or any other 'symbol' I don't see anything wrong with it if its your property.

Our Founders didn't give us the freedom of speech and freedom of assembly to be peaceful and complacent.

You know who has nice, orderly protests with the flag up on a pedastal? North Korea.

It's a symbol, burning it is also symbolic. Symbols don't hurt people.
