But you also have to realize that an innocent girl is dead, and the person who killed her was set free with a history of serial rape.
This isn't an issue of drunk/date rape. His previous crimes weren't explained in detail but it seemed like it was a bigger issue than a one time thing. Why does our system favor the well being of the rapists in the first place? Justify his release any way you want but in the end nothing will justify the death of this girl.

Bingo. System fails a lot of people. Especially the victims of REAL crimes like this one. Meanwhile, 20% of inmates are drug offenders only making room for rapist and violent criminals to be eligible for parole

First Degree Murder, Second Degree, Manslaughter, etc... There are many classifications of murder. The same holds for rape. The worst levels should be mandatory life.

In my view sexual predators should never be set free,he was convicted of these as a teen,he may have been a model prisoner,but how many teenage girls or young woman were walking round in that prison tempting him to repeat offend?.
The fact is he should never have been set free,in my mind he was already a repeat offender by committing this disgusting act in two different states.

A nation that doesn't treat inmates with the same rights as those outside (on a basic level) is a nation that lacks a justice system completely. Serial rape is something that should be considered, and no I don't think they should be out of jail, but again you're just throwing them in a cell to rot and die.
True rehabilitive orginizations are out there, waiting to do the job, but the tax payers won't pay for it. There have been countless bills that have been shot down, that could make people productive members of society. Countless other countries have these programs, we're in the stone age when it comes to prisons.
Surrounding a person around with other murderers/rapists/drug users and not providing true programs to get them out, they arn't going to learn anything. You're right a serial rapist belongs in jail for a long time, but not all sexual offenders do.
Stigmas destroy this country, and this is an example. "Prisoners don't deserve these programs" so they don't get them, and look what happens.
Ultimately our system is going to fail, the way it is right now.

Well rehabilitation programs also depend on the prison, there are several prisons out there that offer programs do have a moderately high success rate, but its not like you can pick your prison.
Even if we don't let the prisoner out they should still have programs to help figure out where these people went wrong and how we correct it, society as a whole could benefit from that. Not to mention the prisoner's time will be better spent and they might even turn out to be an helpful productive remember of the prison system.

Thats exactly what I'm saying! I mean ultimately right now the system fails ya know? I seriously think jail should be more than just holding cells, that just breeds more problems.

Sexual predators are the most difficult breed of offender to rehabilitate. We've seen it time and time again.
Caught, convicted, jailed, set free, repeat the crime.
The problem with one who has been jailed and set free, is that he knows he doesn't want to be jailed again, so what options does that leave him? Either he ignores the urge to rape (almost impossible) or he makes sure the victim cannot testify against him.
Yes, the system failed this girl and now a family is left behind to suffer while the monster is free to relive his "moment" over and over in his mind for years to come.
DEGREES OF CRIMINAL SEXUAL CONDUCT
FIRST DEGREE - Penetration of any cavity, natural or created, with any body part or object, involving the following factors:
“excessive” force
weapon or threat of weapon
victim is under 13 years old
more than one assailant
SECOND DEGREE - Victim is forcibly touched, or forced into physical activity not involving penetration with any of the above factors.
THIRD DEGREE - Penetration not involving any of the above factors, and/or penetration with someone between age of 13-16. Penetration if survivor is under the influence of drugs or alcohol.
FOURTH DEGREE - Contact without any of the above factors.
This means that when you pass a girl up the stands at a football game against her will, you are committing fourth degree sexual assault.
If you pinch a women’s butt at the bar, this is also fourth degree sexual assault.
PENALTIES
FIRST DEGREE Max = Life (20 years)
SECOND DEGREE Max = 15 years
THIRD DEGREE Max = 15 years
FOURTH DEGREE Max = 2 years

Ok. My thoughts are that I think that our judicial part of the government does an over all good job of keeping criminals of the streets. Statisticly, things like this are very rare, and the statistics are what we should be looking at. Just becasue one guy was an exception to the majority does not mean that there is a major problem with the justice system. I personally think the justice system of USA is competent and fair. Sure there will be a few exceptions, but over all the justice system does its job.
On another note.. I have to ask... Why kill her? I always see these types of stories, and it's not the.. forced.. part that hurts me the most.. Even though being forced is bad.. It's definitly a result of human instincts... or.. how you were raised and all that. I can definitly see it in our DNA. I mean.. back in caveman days... I think that .. forced.. was a main way of having a child. The man chose the women. I think this is why, to this day, alot of girls like controlling, and dominant guys. I go so far as to say that some girls even have fantasys of being.. forced.. So being forced over all is a definite result of chemicals in the brain telling the male that this women is attractive "meaning motherly material", and he wants this mother to cary his genes and have his offspring and she hasn't a say in the matter.. OK GOT THAT.
What I cant seem to explain is the killing. Why kill them? Why is the thought of killing someone in a humans DNA and instincts. I guess I understand the self preservation part of the idea, but can someone SERIOUSLY kill someone just to protect there own face? Even then, do they think they are more likely to get away with killing them so they cant talk over letting them live so they can?
I just cant understand how you can react to your high testosterone and lust for dominance that makes you do actions that create a child, but then you kill the host? That is definitly going against our DNa...
