smoking's bad for you, and so are lighters...

so get this a woman is suing a conveince store and the manufacturer of a cigarette lighter. The cigarette lighter blew up in her sons hands while he was playing with it. Her son died.

what do you think?

I don't think she has a very good case, although it was supposedly a manufacturer defect in the lighter...

If there really was a defect, then she probably does have a pretty good case.

Either way, it's tragic and I feel terrible for the mom.

What a coincidence. I was just looking at my lighter the other day and it has a sign that it's "child-safe"

I feel worse for the kid for having a mother who lets him play with a lighter...

Her lawsuit names the convenient store and the manufacturer for being "negligent"? Pot calling the kettle black? I don't care if there was a fault in the lighter. The 2 year old kid shouldn't have been anywhere near it.

crikey, all i can think of is what the hell was in the lighter?! i woulda thought an exploding lighter would have caused at worst some severe burns to the hand. did it have C4 in or something?

It wasn't a matter of it exploding. She is sueing because her kids were able to figure out how to work it and they lit the house on fire. She shouldn't have left it within reach and there wouldn't have been a problem at all.

I've bought lighters from the store that were "cracked-out" before I had a chance to do anything to it. Sometimes lighters will just have the flame cranked up to super in which case there is an explosion hazard. There is a warning right on the side.

As far as the two year old getting their hands on the lighter, I doubt highly she just gave it to him. I loose lighters often, they fall out of your pocket, they're small I misplace them, any smoker can tell you its way easy to loose a lighter. Maybe this kid found it and just started playing with it.

I don't really see suing the store where you bought the lighter though, I work in retail, its not like we quality test all the products before sticking them on the shelf, the manufacturer handles that. That convience store doesn't have the time or desire or the obligation to light each lighter to test it out.

She has my sympathies.

Well don't you agree that it's her own neglect if she loses her lighter when she has young kids around? That's just a total lack of responsibility.
